About these terms
These Terms & Conditions govern use of the DAC Consulting website and the submission of enquiries, consultation requests and Project 120 applications through it. DAC Consulting (“DAC”, “we”, “us” or “our”) provides consulting across People Management, Process Management, and Product and Brand Management. Please read these terms together with our Privacy Policy. If you do not agree with the conditions governing an optional website feature, do not use that feature.
These website terms do not replace a signed proposal, statement of work, consulting agreement, confidentiality agreement or other contract for a particular engagement. That agreement governs its subject matter and prevails over conflicting website terms. Any acceptance required to form a service contract will be obtained separately; browsing this website does not by itself purchase consulting services.
Who may submit a request
Our business enquiry, consultation and initiative application forms are intended for people aged 18 or over. If you act for an organisation, you must have authority to submit the information and make the request on its behalf. You are responsible for ensuring that the details you provide are accurate to the best of your knowledge and that you have the necessary rights and permissions to provide them.
Please do not impersonate another person, submit knowingly misleading applications or use someone else’s contact details without authority. If information changes after submission, contact DAC with the relevant correction.
Using the website responsibly
You may use the website to learn about DAC, review its services and send legitimate requests. You must not use it unlawfully, interfere with its availability or security, introduce malicious code, send spam, attempt unauthorised access to systems or other people’s information, or use automated activity that disrupts the site or its providers. This does not prevent lawful accessibility tools, ordinary search indexing or other uses protected by applicable law.
We may take proportionate steps to protect the website and its users, including restricting abusive requests or temporarily suspending an affected feature. Those steps do not remove statutory rights or rights under a separate engagement agreement.
Website information and business outcomes
Website content describes our services and approach in general terms. It is not a personalised assessment of your organisation and does not constitute legal, tax, investment or other regulated professional advice. Any recommendations for your organisation require an agreed scope and appropriate consideration of its circumstances. You should obtain specialist advice where a matter requires it.
We aim to keep the website useful and accurate, but descriptions may change and errors may occur. Testimonials, case studies, illustrations and examples describe particular experiences or explain our approach; they are not a guarantee of identical results. Business outcomes depend on circumstances, implementation, resources and other factors. Nothing here excludes responsibility for misleading statements or other liability that applicable law does not permit us to exclude.
Enquiries and consultation requests
Submitting the contact or consultation form asks DAC to respond to your request. A confirmation message means that the form service has reported receipt; it does not confirm an appointment, guarantee acceptance of work or establish a consulting relationship. Any meeting time, scope of support, fees and responsibilities will be confirmed separately.
Please provide enough information to understand your request without sending unnecessary confidential, sensitive or third-party personal information. If a form reports an uncertain result, contact DAC before submitting again to avoid duplicate records. Availability and response times depend on the request and our operational capacity; the website does not promise an immediate response.
Consulting engagements, fees and cancellation
A consulting engagement begins only when the relevant parties agree its terms. The engagement documentation should identify the scope, deliverables, responsibilities, schedule, fees and taxes where applicable, payment terms, intellectual property rights, confidentiality, any data processing arrangements, and how changes, cancellation and refunds are handled. The website currently has no checkout or payment-card collection facility.
These website terms do not impose a non-refundable fee, cancellation charge, automatic renewal or subscription. Any such arrangement must be expressly agreed for the relevant engagement and remain subject to mandatory consumer and other legal protections.
Project 120 applications
Project 120 is DAC’s pro-bono consulting initiative with a stated goal of providing ₦300 million worth of consulting services to 120 organisations across Nigeria. This describes the initiative’s aggregate service-value goal; it is not a cash grant, a payment to an applicant or a promise that each selected organisation will receive the same value or scope of support.
Applications are subject to the initiative’s eligibility criteria, selection process and available programme capacity. Submitting an application does not guarantee selection, a particular service, a start date or a business outcome. Support depends on the organisation’s needs and the agreed scope of the initiative. If selected, any participation requirements, timetable, responsibilities and applicable terms will be explained before work proceeds.
Only selection requirements and commitments actually communicated by DAC for the initiative apply; a website application does not create additional undisclosed fees or obligations. Any material changes affecting an accepted participant’s agreed support should be communicated to that participant, subject to the applicable participation terms and law.
Information and material you provide
You retain your rights in the information and material you provide, subject to any separate agreement. By sending it, you permit DAC and the service providers needed for the relevant form or engagement to receive, store and use it for responding to the request, assessing the application or carrying out agreed work, as described in the Privacy Policy. This is not an unrestricted licence to publish your material or use your name or likeness for unrelated advertising.
Do not submit material that is unlawful, infringes another person’s rights or breaches an obligation of confidentiality. Ordinary enquiry forms are not a substitute for a signed non-disclosure agreement or a secure document-transfer process agreed for a project. Please ask DAC about a suitable channel before providing employee records, commercially sensitive documents or other restricted information.
Our website content and third-party materials
Rights in the website’s text, design, branding and other materials remain with DAC or the relevant third-party rights holders, as applicable. You may view the site and make reasonable copies for your own legitimate internal evaluation of our services. Do not misrepresent authorship, remove ownership notices, redistribute substantial content commercially or use DAC branding in a way that suggests an unauthorised relationship.
Third-party names, logos, photographs and illustrations remain subject to their owners’ rights. Their appearance does not grant you a licence to reuse them or imply an endorsement beyond the context stated on the site. Nothing in these terms restricts fair dealing, quotation or another use permitted by law. Ownership and permitted use of engagement deliverables must be addressed in the relevant service agreement.
External services and links
The website uses Web3Forms for general contact delivery, a Google Apps Script endpoint for consultation submissions and Google Forms for Project 120 applications. It also provides external social-profile links. External services have their own terms, privacy policies, availability and account settings. Our Privacy Policy explains the main website data flows; using an external feature may also involve a direct relationship with its operator.
We do not control all changes, interruptions or content on external services. If a feature fails, you may use our contact page to ask about another way to communicate. Our use of a provider does not remove responsibilities that applicable law places on DAC for selecting providers or protecting personal information.
Availability and website changes
We may maintain, correct or update website content and features, and the site or a form may be temporarily unavailable. We do not promise uninterrupted operation, compatibility with every device or that every transmission will be free of errors. Please keep a copy of important information you submit and report a suspected technical problem without sending passwords or other sensitive material.
Changes to the public website do not retrospectively change a signed engagement agreement or remove rights that have already arisen. If a material feature change affects an existing agreed service, the relevant agreement and applicable law govern how it is handled.
Responsibility and legal protections
You remain responsible for decisions you make using general website information rather than advice agreed for your particular circumstances. To the extent permitted by applicable law, DAC does not accept liability for indirect or consequential losses arising solely from use of this general-information website, such as a speculative business opportunity or anticipated profit that is not a reasonably foreseeable result of a breach. Liability for an actual consulting engagement is governed by its agreement and applicable law.
Nothing in these terms excludes or limits liability for fraud, fraudulent misrepresentation, deliberate misconduct, death or personal injury where such an exclusion would be unlawful, breach of mandatory data protection or consumer rights, or any other liability that cannot lawfully be excluded or limited. Any exclusion applies only to the extent legally permitted and does not prevent a remedy required by law.
Applicable law and resolving concerns
These website terms are governed by the laws of the Federal Republic of Nigeria, subject to mandatory rights that apply to you under another applicable law. Please use our contact form to explain a concern so that we can try to resolve it. This does not require you to delay a legal claim or regulatory complaint, or waive a remedy.
Where a dispute cannot be resolved informally, it may be brought before a court or other competent body with lawful jurisdiction. These terms do not require binding arbitration, waive collective remedies or prevent a consumer from using a forum or protection that applicable law makes available. A separate engagement agreement may contain its own lawful dispute-resolution arrangements.
Changes, interpretation and contact
We may revise these website terms as our website and legal requirements change. The “Last updated” date identifies the published version. Material changes apply prospectively, and any notice or fresh agreement required by law will be provided. A change to this page does not itself amend a separate signed agreement.
If a provision is found unenforceable, the remaining provisions continue only to the extent that they can lawfully and fairly operate without it. A delay in enforcing a term is not a general waiver. If you have questions about these terms, contact DAC through the contact page.
